Digital Millennium Copyright Act Policy (DMCA)

This Digital Millennium Copyright Act Policy (“Policy”) governs the kwupdates.com website (“Website” or “Service”) and any of its related products and services (collectively, “Services”) and describes how the Website operator (“Operator”, “we”, “us” or “our”) handles copyright infringement notifications and how you (“you” or “your”) may file a copyright infringement complaint.

We place a high value on intellectual property protection and expect our users and their authorized agents to do the same. At our discretion or as required by law, we may share a copy of your notification or counter-notification with the account holder engaging in the allegedly infringing conduct or for publication. Notifications of infringement

If you are a copyright owner or an agent of a copyright owner and believe that any material available on our services violates your copyrights, please send a written copyright infringement notification (“Notification”) to the DMCA using the contact information provided below. The DMCA guidelines must be followed in all such notifications. You can utilize a DMCA takedown notice or other related services to avoid mistakes and ensure compliance with your Notification.

Filing a DMCA complaint kicks off a predetermined legal process. Your complaint will be investigated to confirm that it is accurate, authentic, and full. If your complaint fits these requirements, we may respond by removing or restricting access to allegedly infringing material, as well as permanently cancelling the accounts of repeat infringers. It is possible to request a backup of the data from the terminated account. However, we may not be able to provide you with one, so you should have your own backups.

If we remove or restrict access to materials or terminate any account in response to a notification of alleged infringement, we will make a good faith effort to contact the affected user with information about the removal or restriction of access, which may include a full copy of your notification (including your name, address, phone number, and email address), as well as for instructions for filing a counter-notification.

Regardless of anything else in this Policy, the Operator reserves the right to take no action in response to a DMCA copyright infringement notification if it fails to meet all of the DMCA’s requirements for such notifications.

Counter-notifications

Under US Copyright Act sections 512 (g) (2) and (3), a user who receives a copyright infringement notification may file a counter-notification (3). If you get a copyright infringement notification, it means that the material referenced in the notification has been removed from our Services or that access to the material has been restricted. Please read the notification, which contains information about the notification that we received. To register a counter-notification with us, you must provide a written declaration that adheres to the DMCA criteria.

Please keep in mind that if you are unsure whether some material infringes the copyrights of others, or if the material or activity was removed or restricted as a result of an error or misidentification, you should contact an attorney before filing a counter-notification.

Regardless of anything else in this Policy, the Operator reserves the right to take no action in the event of a counter-notification. If we receive a counter-notification that satisfies the standards of 17 U.S.C. 512(g), we may forward it to the filer of the original Notification.

The procedure specified in this Policy does not restrict us from seeking any other remedies available to us to resolve an alleged violation.

Modifications and additions

We reserve the right, at our sole discretion, to change this Policy or the rules governing the Website and Services at any time. We’ll update the date at the bottom of this page once we’ve done so. We may also communicate notice to you in other ways, such as through the contact information you have provided, at our discretion.

Unless otherwise specified, an updated version of this Policy takes effect immediately after it is published. Your continued use of the Website and Services beyond the effective date of the updated Policy (or such other act specified at the time) will constitute your acceptance of those changes.
